A medical legal evaluator cannot apportion to genetic risk factors. However, several cases have found that apportionment is permissible if the evaluator explains how this specific person has a specific condition, more than a mere “risk factor” for the industrial injury. Examples include obesity, degenerative disk disease and diabetes.
