Injury caused by intoxication is not compensable pursuant to LC §3600(a)(4). This includes alcohol and controlled substances. To establish an intoxication defense, the defendant must show:
- IW actually consumed the intoxicant
- IW was actually intoxicated
- The intoxication substantially caused the injury
