  1. Employee with permanent partial disability.
  2. Doctor’s opinion that injured worker is unable to return to work (usual and customary).
  3. No offer of mod/alt work, lasting at least 12 months, w/in 30 days of TD termination in form & manner prescribed by AD, & employee rejects or fails to accept.
