In most cases, Benson helps defendants break up the PD where the applicant attorney files multiple claims. The effectiveness of Benson is being somewhat weakened by getting the med-legal evaluators to say that the PD between the two DOIs is “inextricably intertwined.” Therefore, choose your doctors very carefully, particularly AMEs, and be aggressive in cross-examination!
