Based on LC 4615, certain lien claims may be automatically stayed.
- If a lien claimant (physician, DME provider, pharmacy, etc.) has been criminally charged (not convicted) with insurance fraud, then the all of the provider’s lien claims are to be automatically stayed.
- This means that the WCJs technically no longer have jurisdiction over the liens and cannot take any action on the liens, including setting for trial or approving a Lien Stipulation & Order to Pay.
- However, if a lien claimant challenges the stay, the WCJ may set the matter for trial on the sole issue of whether the DWC had the requisite evidence to stay the lien.
- If a lien claimant wins on its challenge of the stay, the lien may be adjudicated just as if it was never stayed.
