Based on LC 4615, certain lien claims may be automatically stayed.

  1. If a lien claimant (physician, DME provider, pharmacy, etc.) has been criminally charged (not convicted) with insurance fraud, then the all of the provider’s lien claims are to be automatically stayed.
  2. This means that the WCJs technically no longer have jurisdiction over the liens and cannot take any action on the liens, including setting for trial or approving a Lien Stipulation & Order to Pay.
  3. However, if a lien claimant challenges the stay, the WCJ may set the matter for trial on the sole issue of whether the DWC had the requisite evidence to stay the lien.
  4. If a lien claimant wins on its challenge of the stay, the lien may be adjudicated just as if it was never stayed.
