Jozef Finneran, of SRTK’s San Fernando Valley/Central Coast office, recently earned a take nothing against lien claimant VQ OrthoCare following a contentious day of trial at the Oxnard Workers’ Compensation Appeals Board. Jozef was able to prove to the satisfaction of the court that VQ OrthoCare did not sufficiently prove that its services were reasonably calculated to provide cure/relief to the effects of an industrial injury. As such, issues such as LC4903.8(d) declaration, improper assignment, validity of the medical provider network, and reasonableness of services/charges were rendered moot. This result is particularly good for the defendant, as it makes the likelihood of reconsideration much less probable.
