Aaron Hemmings Secures a Dismissal of Claim of Injury

Aaron Hemmings secured a dismissal of claim of injury AOE/COE to the spine when the applicant’s credibility was impeached by surveillance video. The applicant’s claim was initially denied but later found to be compensable by an orthopedic panel QME. However, after careful questioning of the applicant during deposition, securing of voluminous records and timely video evidence, the panel QME issued a supplemental report in which he reversed his opinion and concluded that the applicant was of low credibility and ultimately deferred to the Workers’ Compensation Judge as to whether or not there was an injury. At hearing, the judge agreed with the panel QME and the applicant’s claim was dismissed due to lack of credibility.
