Workers’ Compensation

CA Labor Code Section 132a

Section 132a petitions allege discrimination as a result of filing or reporting a work-related injury. If successful, these claims expose employers to penalties as well as mandatory rehiring with payment of retroactive wages – none of which are covered by the employer’s Workers Compensation insurance. With well over half a century of combined experience in defending these often meritless claims, TK Law’s aggressive resolution of Section 132a allegations is unparalleled.

CA Labor Code Section 4553

Employee claims under Section 4553 alleging serious and willful misconduct on the part of the employer are uninsurable in California. If successful, all benefits paid or payable are increased by 50%. These claims are becoming more frequent in an attempt to artificially inflate the value of an applicant’s case. Defending against these claims requires knowledge of tort law beyond the realm of typical workers’ compensation issues. Appellate Representation

When it comes to appellate representation, a deep understanding of the complex laws and regulations surrounding workers’ compensation and appellate law is crucial for success. Our team is composed of effective and experienced attorneys who are highly proficient in written and oral advocacy as well as analytical research skills. They are at the top of their field in advancing appellate representation for our clients and have practical experience in filing Petitions for Removal and Reconsideration at the WCAB level through Writs of Review before the District Court of Appeals as well as the California Supreme Court. Appellate cases are reviewed and vetted by the Appellate Committee in order to appropriately advise our clients of the potential success and ramifications of an appeal given the circumstances in the case. Having provided appellate representation at all levels including the California Supreme Court, our appellate team has the practical experience of what is needed in the form of persuasive argument and appellate law to build a track record of success our clients can rely on.

Public Entity Claims

TK is proud to provide representation in Public Entity and Safety Officer cases for cities, counties, and schools districts. TK also specializes in CalPERS Industrial Disability Retirement  representation, including related Petitions for Writ of Mandate. Our public entity team possesses the experience needed to defend these clams, including the specialized knowledge required in defending Safety Officer claims and presumptive injuries. Our attorneys have provided aggressive representation for numerous public agencies in San Diego, Riverside, San Bernardino, Orange, Los Angeles, Kern, and Ventura counties — including the unincorporated areas of counties themselves — for over three decades. As a result, we have the skill and knowledge to navigate the political and diplomatic considerations that are not infrequently involved in these cases, as well as the complex landscape of laws and regulations in the Labor, Government, and Education Codes that govern work injuries specific to public agency claims.
