Watch out for applicant attorneys to request a rebuttal report from the PTP to a UR non-certification. Why? If the PTP can quickly generate a rebuttal, that rebuttal report must be included in the reports which must be sent to IMR. Also, they can bill the defendants for that report, as well. Remember the Uribe-Ramos panel decision resulting from a Stockton District Office case that held the defendant has an affirmative duty to submit documents to IMR, as already suggested in the CCRs and Labor Code.
