Worker Charged with 11 Felony Counts After Video Evidence Emerges in Workers Compensation Insurance Fraud Case

A worker who sustained injuries repairing a water line subsequently claimed additional injuries and a lack of improvement, and has been charged with multiple felony counts, including workers’ compensation fraud and presenting false documentation in order to receive compensation. Fernando T. Garcia claimed additional body parts and cumulative stress and injury while on modified light duty from an original claim of lumbar strain. The California Department of Insurance opened an investigation into Mr. Garcia’s case and surveillance conducted showed Mr. Garcia lifting heavy objects on multiple occasions, despite claiming a lack of improvement. The Department of Insurance said that a qualified medical evaluation showed that Garcia had “misrepresented his complaints during his examination.” Mr. Garcia is scheduled to appear for a hearing in Kern County Superior Court on Nov. 20th.
